These Terms & Conditions ("Terms") constitute a legal agreement between you and the developer of Photo Upscaler ("we", "us", "our"). By downloading, installing, or using Photo Upscaler (the "App"), you agree to be bound by these Terms and by Apple's Licensed Application End User License Agreement ("Standard EULA"), incorporated here by reference. If you do not agree, do not download or use the App.
You must be able to form a binding contract under the laws of your jurisdiction to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Subject to your compliance with these Terms and Apple's Standard EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Photo Upscaler for your personal or internal business purposes on Mac devices you own or control. You may not: (a) reverse-engineer, decompile, disassemble, or attempt to extract the source code or proprietary AI/machine-learning models of the App; (b) rent, lease, sublicense, resell, or distribute the App; (c) remove or alter any proprietary notices; or (d) use the App for any unlawful purpose, including processing images you do not have the legal right to modify.
Photo Upscaler is optimized specifically for Mac computers powered by Apple Silicon (M1 or later) running macOS 14.6 or higher. We do not guarantee compatibility with older, unsupported, or non-standard hardware or software configurations, and functionality may vary based on your device's performance.
Photo Upscaler is offered as a one-time paid download through the Mac App Store. There are no subscriptions, recurring charges, or auto-renewing in-app purchases associated with the App. Your purchase is a single, one-time transaction processed entirely by Apple; all billing, payment methods, invoices, and receipts are handled by Apple in accordance with the Apple Media Services Terms and Conditions. Refund requests must be submitted directly to Apple, as we do not have the ability to process refunds ourselves and all sales made through the App Store are subject to Apple's refund policies.
Compression currently supports PNG, JPEG, and static WebP files. Animated formats, GIFs, and SVGs are not currently supported. AI enlargement ("upscaling") results are generated algorithmically based on the content of your source image; synthesized or inferred details are an approximation and may vary from real-world features. Results may differ depending on the quality, resolution, and content of the original image, and we make no guarantee of any particular output quality.
You retain all rights, title, and ownership to the images you process using the App. You are solely responsible for ensuring you have the necessary rights or permissions to process, enlarge, or compress any image you use with the App, and for complying with applicable copyright and privacy laws with respect to that content. By default, Photo Upscaler saves separate output files beside original images or to a folder you designate, and does not modify your original files unless you explicitly choose an overwrite option. While safety checks are built into optional overwrite operations, you are strongly encouraged to maintain independent backups of critical original files, as we are not responsible for any loss of, or damage to, your images.
You agree not to use the App to process, generate, or distribute content that is unlawful, infringing, defamatory, or that violates the rights of any third party, including content depicting minors in an exploitative manner. We reserve the right to discontinue support for any use that violates this section.
The Photo Upscaler application, including its branding, design, user interface, trademarks, and embedded machine-learning pipelines, remains the exclusive property of its developer and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the App itself to you. Apple, Mac, and macOS are trademarks of Apple Inc., registered in the U.S. and other countries.
Photo Upscaler is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that AI-enlarged results will meet your expectations.
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, images, profits, or goodwill, arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the App shall not exceed the amount you paid to purchase the App, where permitted by law.
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies in your possession.
These Terms shall be governed by and construed in accordance with the laws applicable to the developer's place of business, without regard to conflict-of-law principles, except to the extent superseded by Apple's Standard EULA or mandatory consumer-protection laws of your country of residence.
We reserve the right to revise or update these Terms at any time. Material changes will be reflected by an updated "Effective Date" below. Your continued use of the App after any such update constitutes your acceptance of the revised Terms.
